A coalition of NYC employees, retirees, and an advocacy group is suing to dam a sweeping health-benefits restructuring that will reshape protection for roughly 750,000 public-sector employees and retirees.

The lawsuit, filed Tuesday, challenges town’s plan to switch its long-standing, insured health-care protection with what the coalition calls an illegal, self-funded mannequin that will strip away protections assured by state legislation.

The authorized problem comes on the heels of a vote final month by the Municipal Labor Committee, a coalition of greater than 100 metropolis employee unions, approving a shift of lively workers and pre-Medicare retirees to a brand new plan starting Jan. 1, 2026.

The Metropolis has beforehand acknowledged that the brand new plan will preserve zero premiums and save roughly $1 billion yearly in health-benefit prices. Metropolis officers didn’t instantly return requests for touch upon the Oct. 29 lawsuit.

The authorized problem argues that town’s plan to switch the GHI Complete Advantages Plan with a brand new Administrative Companies Solely mannequin, branded NYCE PPO, violates the New York Metropolis Administrative Code.

The code requires that municipal employees, retirees, and their dependents be supplied with medical insurance protection by way of licensed insurers that assume monetary threat and are regulated by the state.

Below the brand new construction, the Metropolis would pay medical claims instantly from its personal funds, whereas UMR, a subsidiary of UnitedHealthcare, and EmblemHealth would administer claims however not insure them.

The lawsuit argues that as a result of the Metropolis would now not be utilizing a licensed service, the plan can not legally qualify as “health insurance coverage” with out amending the Administrative Code.

By making the Metropolis of New York answerable for paying claims, the coalition says, protection would rely on the Metropolis’s funds and political priorities. The petition additionally cites contract language that permits the Metropolis to alter advantages, copays and deductibles at any time, calling it illegal and arbitrary.

“New York City’s new self-funded healthcare plan will strip hundreds of thousands of municipal employees, retirees, and their dependents of key protections guaranteed by state law, including essential-benefit standards, state oversight, and solvency requirements,” stated Gregory J. Dubinsky of Holwell Shuster & Goldberg LLP, who filed the go well with.

“The plan states the City will be in charge of deciding plan benefits. This suit seeks to compel the City to follow the law and provide health coverage through a licensed, regulated insurer that operates under statutory safeguards,” Dubinsky added.

‘If the City runs out of money, we will run out of healthcare’

The Administrative Companies Settlement for the brand new plan is presently beneath a 30-day evaluation by Metropolis Comptroller Brad Lander, which is sunsetting on Nov. 13. He might certify or reject the contract at any time earlier than the deadline.

Lander’s workplace didn’t instantly reply to requests for touch upon the matter.

The advocacy group behind the problem, Palms Off NY Care, has additionally employed a cell LED truck to circle the Lander’s workplace this week to focus on the pending determination and the lawsuit.

The lawsuit additionally consists of first-person accounts from workers and retirees who say the change places their well being and lives in danger.

George Anderson, a medical advocacy director elevating two toddlers, stated he fears dropping entry to his kids’s medical doctors in New Jersey as a result of town has supplied incomplete details about lined suppliers beneath the brand new plan.

Migdalia Acevedo, who labored close to Floor Zero through the Sept. 11, 2001, terrorist assaults and suffers ongoing medical points, stated she is accelerating a deliberate hip substitute into 2025 to make sure the process is accomplished earlier than her protection is shifted. “If the City runs out of money, we will run out of healthcare,” she stated in an affidavit.

One other plaintiff, Samy Mahmoud, who has Crohn’s illness requiring frequent expensive infusions, informed the courtroom he’s “one automatic denial away” from monetary disaster if town delays paying claims beneath the proposed plan.

Retirees additionally categorical considerations about dropping the lifetime advantages they are saying they have been promised. Raeann Singleton, who’s present process therapy for uterine most cancers, warned that even a short lived lapse in protection “could cost [her] [her] life.”
